Formele voorwaarden:
- Uw loon wordt niet betaald en u kunt stellen en aantonen dat de werkgever ook andere crediteuren onbetaald laat. Het meest eenvoudige is om collega’s te verzamelen die ook hun loon niet krijgen uitbetaald. De werkgever moet rijp zijn voor een faillissement doordat hij is opgehouden zijn schulden te betalen.
Inhoudelijke voorwaarden/aandachtspunten
- U kunt zonder omhaal stellen dat u een loonvordering heeft. U heeft een op schrift gestelde arbeidsovereenkomst of kunt die eenvoudig aantonen en kunt een opgave geven van het achterstallig loon.
- U heeft andere schuldeisers die hun vordering ook duidelijk kunnen stellen en aantonen. De vordering moet niet bewtist kunnen worden.
KOSTEN
- Het aanvragen en het voeren van de procedure bij de rechtbank kost € 750,00 exclusief griffierecht.
- U komt mogelijk voor gefinancierde rechtsbijstand in aanmerking. In dat geval is dat het maximumbedrag.
